Illinois Workers’ Compensation Law

 

Am I covered by Illinois Workers’ Compensation law?

 

You are covered by Illinois Workers’ Compensation law if: your injury occurs in Illinois; if you were hired in Illinois; or if your work is principally localized in Illinois. 

 

If you are hurt in Illinois, for example if you slip and fall at O’Hare, your injury is covered by Illinois law no matter where you are domiciled or where you live.

 

If you were hired in Illinois, for example your application was accepted and you did your training in Chicago, your injury is covered by Illinois law no matter where you get hurt or how many times you have been transferred to a different domicile.

 

Finally, if your work is principally localized in Illinois, for example if your domicile is Chicago, your injury is covered by Illinois law no matter where you get hurt, where you got hired or where you live.

 

Am I covered by Workers’ Comp while I am on layover?

 

Yes, you are covered by workers’ compensation when you get hurt on layover, even though you may not actually be engaging in a work-related activity at the time.  Because you are a traveling employee, you are covered by workers compensation on a layover whenever you are engaging in an activity that is reasonable and foreseeable to the employer.  For example if you are on a layover and are injured recreating or if you are injured when you slip and fall on your way to dinner, your accidental injuries are covered under workers’ compensation.
